Illinois courts have recognized this as well. Peoria Attorney John Lesaganich was the attorney for the injured worker in the seminal Illinois case, Peoria County Belwood Nursing Home v. The Industrial Commission, 115 Ill.2d 524, 505 N.E.2d 1026 (1987). This case established that employees who have injuries that have developed gradually over time are just as entitled to workers' compensation benefits as are employees who have a sudden accident at work. The court called these injuries "repetitive trauma" injuries. The court said that it would not deny workers' compensation benefits to employees who have faithfully performed their job duties, even though they experienced the bodily discomfort and damage of repetitive trauma injuries.
